Will I qualify for a Canada Immigration Visa under the Federal Skilled Worker category?

One needs to be eligible to apply for a Canada Immigration (Permanent Resident) Visa under the Skilled Worker category, and should meet various requirements to lodge a successful application:

Have worked continuously for a period of at least one year, within the last ten years, in a full-time, or part-time equivalent paid position in one of Citizenship and Immigration Canada’s qualifying occupations; or have Arranged Employment; or have been legally residing in Canada for one year as a Temporary Foreign Worker; or International Student and currently be residing in Canada. One should also have sufficient funds for settlement in Canada, unless the applicant has an Arranged Employment in Canada.

The applicant should have sufficient points to qualify in the selection factors to meet the pass mark under the Skilled Worker category.

Also, an applicant applying for a Canada Immigration Visa and for their family member and non-accompanying dependents, under all categories of Canadian Immigration, must satisfy Canadian health and security/criminality requirements.

Will I qualify as a Federal Skilled Worker if I do not have the required work experience in the present qualifying occupations list ?

One can still qualify if an applicant does not have his occupation listed in the Federal Skilled working class provided if you have lived in Canada for at least one year as a Temporary Foreign Worker or an International Student and can meet the present pass mark.

An applicant can also qualify if you have an Arranged Employment in Canada and meet the pass mark.

How many people will qualify to be granted the permanent residence to Canada this year?

Every year there are thousands of applicant applying for their Permanent Residence visa to Canada. Citizen and Immigration Canada is committed to admit approximately 2, 65,000 new Permanent Residents for the year 2010, divided amongst Skilled Worker, Family and Business categories.

Under the Skilled Worker category will I qualify and what is the next step?

Will I qualify under the Skilled Worker category even if I score less than present pass mark?

If you have the pass mark under the present points, yes your application can be accepted for consideration and Canada accepts Skilled Workers based upon their ability to become economically established in Canada.

If the Canadian Immigration Case Officer believes that the point total does not accurately reflect your ability to become economically established in Canada, the Canadian Immigration Visa Officer may use his or her positive discretion and approve your application even though you score less than the required points. However, at a minimum, you must have worked continuously for a period of at least one year, within the last ten years, in a full-time or part-time equivalent paid position at a skill level recognized by Citizenship and Immigration Canada. Also you must meet Citizenship & Immigration Canada requirements, such as:

Have one continuous paid full-time work experience in the qualifying occupations in the past 10 years; Have one year of legal residence in Canada as a Temporary Foreign Worker or International Student and currently be residing in Canada or Arranged Employment.

On a family class what is the processing time taken for a sponsorship application to be processed ?

Presently there is a huge backlog of family class applications that are waiting to be assessed and approved. The present waiting period has gone up long from the existing processing time of 6 to 8 months that used to be. The government's aim is to process applications within 6 months of the date they are received.

Time taken to sponsor parents is taking too long, and what can be done about it?

Unfortunately for parents, priority is given to spousal cases, and cases involving dependent children or orphaned children. If there are adequate arrangements for parents and they have their own medical cover in Canada, it is often possible for them to stay in Canada as visitors while their application is processed.

What is a common-law partner?

  An individual who is cohabiting with the person in a conjugal relationship and having so cohabited for a period of at least one year is called a common-law partner.

Will I be eligible to sponsor someone if I am not currently living in Canada, if I am a permanent resident of Canada ?

Only a permanent resident is allowed to sponsor if you are currently residing in Canada under The Federal program Some Provincial prorams for sponsorship are available in specific cases, however given that you do not appear to be resident in any Canadian Province, none of those programs will allow you to sponsor either

What is the requirement if the government refuses my sponsorship application?

An Appeal can be filed with the Immigration Appeal Division if the Processing of the permanent residence application is occurring outside Canada. There is a process to apply for leave to appeal in Federal Court. Only the Federal Court can review the application and look at its merit before a decision can be made.

Does purchasing real estate in canada make me eligible to immigrate?

No, purchasing real estate in Canada does not confer any benefits in terms of immigration.

Can I immigrate under the Federal Entrepreneur program?

The Federal Entrepreneur program has requirements that must be met - specific criteria relating to a business you owned previously, as well as requirements related to the purchase of a "qualifying business". How long does the spouse visa take and business applications for approval?

Spousal cases and temporary work visas are processed fast based on the documentations are all in order, however applicants requiring professional registration or a personal interview may find that this adds several months to their processing time. What is a permanent resident or landed immigrant?

The Canadian Government presently allows dual nationality i.e. the holding of two passports, so you can retain your current passport and obtain a Canadian passport as well.
