UK FAMILY VISAS

Based on an applicant’s business expertise or if an applicant has an offer of employment from a UK based company the UK Work permits and UK business visas are granted.  UK also offers a range of visa services which allow foreign nationals to move to the UK based upon their family connections with a UK permanent resident or a UK Citizen.

UK MARRIAGE VISA

A person, who is a UK resident, can get the husband, wife or civil partner to join him/her permanently in the UK under UK Marriage visa. The spouse visa is granted for a two year period. Once this initial grant has been completed, the visa applicant may apply for Indefinite Leave to Remain in the UK and after a third year it may be possible to undergo the process of British naturalisation to become a UK citizen. Most UK family immigration routes a marriage visa allows the applicant to begin living and working in the UK upon arrival.
UK FIANCE VISA
The UK Fiancé Visa allows a UK citizen or UK Permanent resident to bring their fiancé to the UK in order to marry. Unlike a marriage visa or De Facto visa, it is not necessary to provide proof under this category and nor the applicant or the fiancé have to show that their relationship has already existed for a specified period.
However, the condition is that parties must marry within six months of arriving in the UK is integral to this visa route and the applicant will only be allowed to remain in the UK on a permanent basis once the marriage has taken place. Once this is achieved a two year marriage visa will be issued under which the marriage visa rules outlined above will apply.
Applicants must intend to live with there UK fiancé / fiancée after the marriage has taken place. Furthermore adequate and available housing needs to be available without the need of financial support from public funds.
The applicant (the UK citizen or permanent resident) needs to demonstrate that they can support their foreign partner without recourse on public funds, or their fiancé / fiancée working.
Successful applicants for a UK fiancé visa cannot work under this permit. However after the marriage if an application for two year stay is granted then the fiancé / fiancée are able to take up work.
UK DEPENDENCY VISA
UK Dependency visas apply to wide range of relatives, who can be sponsored by a UK citizen or permanent resident to migrate to the UK. Such an application is based upon an applicant’s dependency on a person who is present and settled as a permanent resident or a UK citizen, and who is supporting the UK visa application. A UK Dependency visa application has no immigration related restrictions on the type of work or business a person may undertake upon arrival.
An applicant who has the Dependency visa granted is eligible to live and work in the UK and after 5 years in the United Kingdom they may be able to pursue a grant of UK Citizenship.
There is no specific time limit imposed on Dependency visa applicant and applicants are granted Indefinite Leave to Remain in the UK on the strength of their familial ties to the country.
Applicants must be related to their sponsor in UK in one of the following ways:
•    A Parent or Grandparent aged 65 or over, on in exceptional circumstances under the age of 65.
•    A child, sibling, aunt or uncle over the age of 18 who is living alone and mainly dependent upon relatives who are settled in the UK.
•    In all cases it must be shown that the applicant is financially dependent upon the sponsoring relative and that they can be financially supported without recourse to public funds. It must also be demonstrated that the applicant has no other relative in their country of residence who could offer them financial support.
The UK dependency visa also applies to the spouse or partner of people immigrating to the UK through other work or business based visa services such as the Highly Skilled Migrant Programme (HSMP) entrepreneur visa, innovator visa or a UK work permit. However the rights given to such dependents for example the right to work in the UK will vary depending upon the visa status of the principle applicant.
